The Constitutional Court of Bosnia and Herzegovina is the highest authority for the protection of human rights and fundamental freedoms. When ordinary courts fail to provide adequate protection, an appeal to the Constitutional Court allows individuals and legal entities to request protection of their rights guaranteed by the Constitution and the European Convention on Human Rights.
👤 Who can file an appeal?
Any natural or legal person, regardless of nationality, may file an appeal if a final decision of a court or authority has violated their rights.
⏱️ Deadline for filing
The appeal must be filed within 60 days from the date the final decision is received. Late appeals are dismissed.
⚖️ Common rights protected before the Constitutional Court:
– Right to a fair trial
– Right to property
– Prohibition of discrimination
– Right to private and family life
– Freedom of expression and religion
– Freedom of movement
– Prohibition of torture and inhumane treatment
🧾 Why is professional preparation necessary?
The appeal must be legally reasoned and supported by relevant case law. Poorly drafted appeals are often dismissed.
