🏛️ What does the probate process include?
The process determines:
- who the heirs are,
- which assets form the estate,
- whether heirs accept or renounce inheritance.
The estate may include:
- real estate,
- vehicles and movable assets,
- funds in bank accounts,
- company shares and other rights,
- as well as obligations of the deceased.
👨👩👧👦 How is inheritance divided? (Inheritance Orders)
Inheritance in BiH is distributed according to legal inheritance ranks:
1️⃣ First Rank
If the deceased had children – the children and spouse divide the estate equally.
2️⃣ Second Rank
If there are no children – the spouse and parents inherit.
3️⃣ Third Rank
If there are no children, spouse, or parents – grandparents inherit.
🔄 Right of Representation
If one heir passed away before the deceased, their descendants inherit in their place.
💡 Important to Know
An heir is responsible for the deceased’s debts only up to the value of the inherited property.
If an heir does not attend the probate hearing, it is considered that they accept the inheritance unless stated otherwise.
