Termination of a Gift Agreement Due to Gross Ingratitude – When Can a Gift Be Returned?

If a recipient behaves offensively or abusively after receiving a gift, the donor may have the right to request the return of the gift.

This is legally possible, but only under specific conditions.

⚖️ Legal Basis

The Civil Code provides that a gift cannot normally be revoked, except in cases of:

– Subsequent impoverishment of the donor

– Gross ingratitude of the recipient

A lawsuit is filed before the competent court. It must be proven that:

– A gift was made

– The recipient acted in a grossly ungrateful manner

– The behavior is connected to the gift itself
